These SMS Terms apply to text messages sent by The Buildwick INC., doing business as DenteCure ("DenteCure," "we," "us," or "our"), and by dental practices through the DenteCure platform. By agreeing to receive text messages you accept these SMS Terms, together with our Terms of Service and Privacy Policy.
Program description
Text messages sent through DenteCure fall into these programs:
- Appointment messages: reminders, confirmations, and notices when a visit is booked, moved or canceled, sent by your dental practice.
- Billing messages: a link to view or pay a balance, sent by your dental practice.
- Follow-up messages: a reply after a missed call, or care and treatment follow-ups your practice sends.
- Practice team alerts: appointment alerts and verification codes sent to a practice's own doctors and staff who turn them on.
- Account and security messages: service notices for DenteCure account holders.
- Marketing messages: sent only to people who have given prior express written consent.
Each message names the practice or DenteCure as the sender.
Consent
Patients
Practices that use DenteCure to text their patients must get consent first: prior express consent for appointment and other informational messages, and prior express written consent for marketing messages. Acceptable ways to get consent include:
- A signed intake form with an SMS consent checkbox and clear disclosure
- An online form with an unticked opt-in checkbox and disclosure
- Verbal consent recorded in the patient's file
- A reply to a first text asking the patient to opt in (double opt-in)
Consent must never be a condition of treatment or purchase. Patients must be told how often they may receive messages, that carrier charges may apply, and that they can opt out at any time. Practices can use wording such as:
"By providing your phone number, you agree to receive text messages from [Practice Name] about your appointments, reminders and care. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help." This is sample wording only, not legal advice. Practices should confirm their wording with their own counsel.
Practice team members
A doctor or staff member who turns on appointment alerts confirms their number with a one-time code, and can turn alerts off in their account at any time or reply STOP.
Message frequency
How many messages you receive depends on your appointments, your account activity and your practice's settings. Typically:
- Two or three messages for each appointment (confirmation and reminders)
- One message after a visit or a missed call, where the practice uses them
- Billing and account messages only when something needs your attention
Under standard settings, patients usually receive no more than four to six messages a month. The frequency of any marketing program is stated when you opt in.
Stopping and restarting messages
- Reply STOP to any message to stop messages from that number at once. CANCEL, END, QUIT, UNSUBSCRIBE and REMOVE work the same way.
- You will receive one message confirming that you have opted out, and nothing more unless you opt back in.
- Reply START, YES or UNSTOP to the same number to receive messages again, or ask your practice to update your preferences.
- Reply HELP for help, or email us.
Most text messages sent through DenteCure are notices, and replies other than these keywords may not be monitored. To reach your practice quickly, use the patient app or call the practice.
Carriers and charges
Messages are designed to work on all major U.S. carriers, including AT&T, T-Mobile and Verizon. Carrier support can change without notice. Message and data rates may apply, set by your mobile carrier, and DenteCure is not responsible for them. Delivery depends on network availability, and we are not responsible for messages that are delayed or not delivered because of carrier limits, technical failures or other causes beyond our reasonable control.
Prohibited uses
Practices may not use DenteCure to:
- Send commercial messages to anyone who has not given valid consent
- Send false, misleading or deceptive content
- Send content that is illegal, abusive, harassing, defamatory or obscene
- Impersonate any person, organization or brand
- Send promotional messages outside 8:00 AM to 9:00 PM in the recipient's local time
- Text numbers on the National Do Not Call Registry for marketing without express written consent
- Break the TCPA, the CAN-SPAM Act, CTIA guidelines or carrier codes of conduct
Breaking these rules can lead to immediate suspension of text messaging and may expose the practice to legal liability.
TCPA and state law
DenteCure's messaging tools are designed to support compliance with the Telephone Consumer Protection Act (47 U.S.C. § 227), but each practice is solely responsible for its own compliance. Practices should keep consent records for at least five years, honor opt-outs (DenteCure applies them automatically), send marketing only between 8:00 AM and 9:00 PM local time, identify themselves in every message, and follow state laws that can be stricter than federal law, such as those in Florida, Maryland and Oklahoma. We do not provide legal advice and recommend that practices consult a telecommunications attorney.
Carrier registration (10DLC)
DenteCure sends text messages from registered 10-digit long code (10DLC) numbers, with each campaign registered with The Campaign Registry, including its use case, how people opt in, and links to these terms and our privacy policy. Carriers set sending limits based on the trust score given at registration, and approval is decided by the registry and carriers. Practices must keep their messages within the registered use case.
Text messages and health information
Standard text messages are not encrypted end to end. DenteCure's appointment and billing texts are written to carry only what is needed, without clinical details, and point to the patient app for anything more. Practices should treat texting as part of their own HIPAA risk analysis, keep messages to the minimum necessary, and get a patient's acknowledgement where a message would contain health information.
Privacy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text message opt-in data and consent are never shared with any third party, except the providers that deliver the messages. Our Privacy Policy explains how we handle all other information.
Limitation of liability
DenteCure is not liable for damages arising from: (a) messages that are not delivered because of carrier limits, network outages or the recipient's device; (b) charges from a recipient's carrier; (c) the content of messages a practice writes or approves; or (d) any breach of the TCPA, state law or other rules caused by a practice's failure to get consent or follow the law. The limitation of liability in our Terms of Service applies to all text message claims.
